These Terms and Conditions govern your use of Mayatax’s services. By engaging Mayatax for tax preparation, bookkeeping, payroll processing, tax planning, or any other services, you agree to these terms. Please read carefully.
Mayatax provides tax preparation, tax planning, bookkeeping, payroll processing, sales tax compliance, financial reporting, controller support, CFO advisory, business advisory, IRS notice resolution, tax compliance, and financial operations support. These are advisory and administrative services. Mayatax is not a licensed CPA firm, public accounting firm, or legal firm. We do not provide audit services, assurance services, attest services, legal advice, or formal legal representation. For audit, assurance, legal, or other specialized services, you should consult with appropriately licensed professionals.
You are responsible for providing accurate and complete financial information, documents, and records. You are responsible for understanding and complying with all applicable tax laws, regulations, and filing requirements. You retain full responsibility for the accuracy of information you provide and decisions you make regarding your taxes and finances. Mayatax relies on the information you provide and does not independently verify its completeness or accuracy.
The scope of services is defined by your engagement letter or service agreement with Mayatax. Services are limited to what is specified in that agreement. Mayatax will not provide services beyond the agreed scope without additional discussion and fee arrangement. Any changes to the scope of work require written approval from both parties.
Fees are quoted based on the services requested and your situation’s complexity. Fees are due upon receipt of invoice unless other payment terms are agreed in writing. Late payments may result in service suspension. Fees are non-refundable once services have been rendered, except as required by law. Mayatax reserves the right to terminate service for non-payment.
Mayatax does not guarantee specific tax outcomes, refunds, or protection from IRS action. Tax preparation and planning services are based on current law and regulations, which may change. We cannot predict how tax authorities will interpret or apply the law to your specific situation. We prepare returns in accordance with applicable law based on information provided. Results depend on many factors beyond our control.
Mayatax’s liability for any claim arising from our services is limited to the fees paid for those services. Mayatax will not be liable for indirect, consequential, or punitive damages. You agree to hold Mayatax harmless from claims arising from your use of information we provided or decisions you made based on our recommendations. Our liability is limited to errors or omissions in our work within the scope of services provided.
Mayatax maintains confidentiality of your financial and business information. We will not disclose your information to third parties except as required by law, to provide the services you requested, or as permitted by professional standards. Information may be shared with government agencies (IRS, state tax agencies) as required for filing, compliance, or legal obligations. By engaging Mayatax, you authorize necessary information sharing for service delivery and legal compliance.
Mayatax retains financial records and tax documents as required by law. You may request copies of records or access to your files. Mayatax may charge a reasonable fee for document retrieval or copying. Upon engagement termination, Mayatax will provide or return client documents as required by law and professional standards.
Mayatax provides services in accordance with applicable professional standards and regulations. We follow applicable tax law and IRS regulations. We are not bound by professional standards or requirements applicable only to licensed CPA firms or public accounting firms. If you require services subject to CPA licensing requirements, we will refer you to appropriately licensed professionals.
Unless specifically authorized in writing by you and by the IRS, Mayatax does not represent you before the IRS. We provide support and guidance regarding IRS communications and notices. Any formal representation before the IRS requires proper authority and authorization. You are responsible for understanding what level of support we provide regarding IRS matters.
Either party may terminate the engagement with written notice. Upon termination, you remain responsible for fees owed for services rendered. Mayatax will provide records and documents as required by law. Termination does not affect obligations for services already provided or information already shared.
Mayatax may modify these Terms and Conditions at any time. Continued engagement with Mayatax after modifications means acceptance of the updated terms. Significant changes will be communicated to you in writing.
Any disputes arising from these terms or our services will be governed by Texas law. Both parties agree to make good faith efforts to resolve disputes before pursuing legal action. This agreement is binding on both parties and their heirs, successors, and assigns.
